These Terms of Service govern your use of the online hosting services provided by Sleepless Hosting. By using our services, you agree to be bound by the terms and conditions outlined in this Agreement. Please read this Agreement carefully before accessing or using our services.

1. Personal Information Collection and Use

1.1. As part of the registration process and for the purpose of identification and payment, we collect personal information including but not limited to email, name, phone number, street address, and IP address. We assure you that we will handle your personal information in accordance with our Privacy Policy.

1.2. We may also use your personal information to contact you when necessary and to provide you with important updates, announcements, and information related to our services. You may opt-out of receiving these communications, except those necessary for the proper functioning of our services.

1.3. We may use temporary site cookies to enhance your user experience, facilitate authentication, and track usage patterns on our platform. You have the option to manage cookie settings through your browser preferences.

2. Limitation of Free Trials

2.1. We offer a limited number of free 30-day service trials to new users. Each user is entitled to a maximum of one free trial.

2.2. The free trial period begins on the date of account activation and lasts for 30 consecutive days. If you choose to continue using our services beyond the trial period, you will be required to renew your service via the client dashboard.

2.3. We reserve the right to determine eligibility for free trials and to modify or terminate this offer at any time without prior notice.

3. User Responsibilities and Conduct

3.1. By using our services, you agree to provide accurate and up-to-date information during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2. You agree not to use our services for any unlawful, harmful, or malicious activities. This includes but is not limited to transmitting any content that is illegal, infringing, defamatory, or violates the rights of others.

3.3. You acknowledge that any content uploaded or transmitted through our services is your sole responsibility, and you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of providing and promoting our services.

4. User Account Limit

4.1. You are only allowed one server. Upon discovery of an alternate account, you will be permanently banned from our services due to breaking the User Agreement of one account per user.

5. Intellectual Property Rights

5.1. All intellectual property rights, including copyrights, trademarks, and trade secrets, in our services and related materials are owned by us or our licensors. You agree not to reproduce, modify, distribute, or create derivative works based on our services or any part thereof, unless explicitly permitted by us.

6. Termination

6.1. We reserve the right to suspend or terminate your access to our services at any time, with or without cause and without prior notice. In case of termination, you will be responsible for any outstanding fees, if applicable.

6.2. Upon termination, your access to your account and any associated data may be permanently deleted. We are not responsible for any loss of data or content resulting from termination.

7. Disclaimer of Warranties

7.1. Our services are provided on an "as is" and "as available" basis, without any warranties or representations, expressed or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure.

8. Limitation of Liability

8.1. In no event shall we be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.

9. Amendments to the Agreement

9.1. We reserve the right to modify or update this Agreement at any time, without prior notice. It is your responsibility to review this Agreement periodically for any changes. Your continued use of our services after the modifications signify your acceptance of the updated Agreement.

By using our services, you acknowledge that you have read, understood, and agreed to be bound by this Terms of Service Agreement. If you do not agree to these terms and conditions, you may not use our services.
